Guam - In the case of Cristobal vs. Siegel, the Guam Supreme Court has decided that the Superior Court "abused its discretion" by denying the Cristobals' motion for reconsideration. The Plaintiffs included the Cristobals and others who filed a complaint for fraud, damages, and cancellation of instruments against Defendants Jeffrey Siegel, Francis Gill, and Coral Pit, Inc. [now known as Bottomless Pit, LLC].
According to a release from the Guam Judiciary, the parties entered into a settlement agreement to resolve the dispute and the Superior Court then entered a final judgment and dismissed the case.
Bottomless Pit filed a motion requesting the Superior Court to direct the plaintiffs [Cristobal] to convey a portion of property to them. The court agreed.
The Plaintiffs [Cristobal] asked the Superior Court to reconsider arguing that Bottomless Pit wasn't entitled to relief because the settlement did not constitute a judgment. The Superior court disagreed, denied the motion, and the Cristobals appealed.
In an opinion authored by Justice Robert J. Torres and concurred by Chief Justice F. Phillip Carbullido and Justice Katherine A. Maraman, the Supreme Court held that the Superior Court abused its discretion in denying the Cristobals' motion for reconsideration. And they held they agreed that the final settlement ... did not direct a party to execute a conveyance of land.
