Tunisia Ben Ali son-in-law granted asylum in Seychelles
The son-in-law of Tunisia's former president has been granted asylum in the Seychelles, officials say.
Businessman Sakher El Materi was arrested as he tried to enter in the island state in December 2012 and reportedly applied to stay in February.
He had fled Tunisia for Qatar after the uprising that ousted President Zine al-Abidine Ben Ali in January 2011.
Months later, a court in Tunisian convicted him of corruption in absentia.
Materi, along with his wife and their three children, have now been granted a 12-month residence permit in the Seychelles, according to its immigration department.
The Indian Ocean archipelago was a regular holiday destination for the former president and his close family.
The country's law did not make specific provisions for political asylum, a government statement said.
But the permit was issued because it believed Materi would not receive justice in his home nation, according to AFP news agency.
"The government of Seychelles has not satisfied itself that the conditions exist in Tunisia at this point for a free and fair trial if Mr El Materi were to be repatriated back to face the charges set out against him there," immigration officials said.
Materi was convicted of corruption in absentia, along with his wife, Nesrine, and her father, Tunisia's ousted president.
Materi and Ben Ali were sentenced to 16 years in prison and Nesrine was given an eight-year jail term.

Tunisia has formally requested the Seychelles authorities to stop the son of the deposed president Sakhr Elmatri by referring to an international arrest warrant issued against him.
This request was made after obtaining Sakhr Materi and his family a residence permit for one year in the Seychelles.
The Department of Immigration Seychelles expressed concern that the son of the deposed president could not enjoy a fair trial in Tunisia to justify its decision.
On the run since January 2011, Sakhr Materi continued in several corruption cases.
Adel Riahi, director of the Information Office at the Department of Justice states that an international arrest warrant was issued against Mr. Materi and that it is on the red list.
Mr. Riahi emphasizes the need to respect international law.

Asylum claims can and should, wherever possible, be made to an immigration officer as soon as an asylum seeker arrives at his/her first port of call.
ReplyDeleteAsylum seekers have been convicted for using false passports or travel documents (for example, to leave their country of origin). Their conviction then adversely affects their credibility when their asylum claim is considered.
In addition to the evidence submitted by the asylum applicant, case owners take into account other information such as sources of information on the political and human rights situation in the person’s country of origin which in the case of El MATERI was Qatar.
Claim may be harmed if they delayed claiming asylum without good reason, or if they have been convicted of a criminal offence such as using false travel documentation, or if they did not claim asylum in the first safe country they reached after leaving their own country (known as a ‘safe third country’).
El Materi and the Seychelles Government has not followed the regulations.

You right Jeanne.El Materi first destination was Saudi Arabia,therefore Saudis should be concern of whether to send him back or not.In Seychelles' case the normal procedures is to send him back to the last destination prior to landing in Seychelles.
ReplyDeleteI have read those Interantional laws too.An example,let say Mugabe flees Zimbabwe through Kenya,then some times later he illegally present himself at Seychelles' port of entry,the normal procedure for our governemnt would be to send him back to Kenya where he come from. That is what PL did when El Materi first tired to enter our country illegally.He was deported to the country he deaprted from prior to entering Seychelles and that should have been again the procedures to follow by the government.So as you say the governemnt attempt to justify thier acts do not hold water.

“I am pleased to announce that, in support of the government’s home-grown economic reform agenda, the Tunisian authorities and IMF staff have reached a staff-level agreement on a 24-month Stand-By Arrangement (SBA) in the amount of US$1.75 billion (equivalent to about SDR 1.14 billion, or 400 percent of Tunisia's quota in the IMF). This agreement will be subject to approval by the IMF’s Executive Board, which is expected to consider Tunisia's request next month.
“The SBA, once approved by the Executive Board, would support the authorities’ economic agenda aimed at preserving fiscal and external stability, fostering higher and more inclusive growth, and addressing critical vulnerabilities of the banking sector.

“These reforms are expected to help address many of Tunisia’s pressing economic and social challenges, and contribute to reducing risks that could arise from a worsening of the international economic environment or from protracted political uncertainty. These reforms deserve the support of the IMF and the international community through financial assistance, policy advice, and technical assistance.”

They love to attend meetings and seminars to beg for grants and loans from us Arabs! Their arguments are always the same - Piracy - Tsunami - and now weather change. For Allah sake! there are other countries that have the worse case scenarios and poverty than the gold souks Seychelles. Those fat-arsed have more cars than they have roads on the island of Sun, Sand and Sex! The infidels are always insulting us Arabs instead of being thankful. The case shows the similarities between judiciary in Kenya and judiciary in Seychelles and we should not be proud of that. If Seychelles and Kenya have different constitutions and both courts come to the same decision, then one of them is wrong. McGregor and Twomy can do their propaganda. We say the judgements are corrupt if the judges are too close to parti Lepep, the judges take too many favours from parti Lepep and then give pro-government decisions. It makes no difference to our opinion if judges in Africa with similar backgrounds support them or use them as an excuse to give pro-government decisions. McGregor and Twomy know what they need to do to redeem themselves as judges. The propaganda in Nation makes things worse for them and their integrity.

Oh My Goodness what more does Deenu want. He has brought his entire family from India to Seychelles by paying Ogilvie Berlouis who was at that time minister for immigration. ReplyDelete1- simply Seychelle is part of Geneva convention and 1967 protocol and part of that UNHRC refugee treaty agreement ( meaning this countries shall provide asylum to refugees and have no right turn its back to the refugees and UN will assist in supporting them { with money }so its very unwise to refuse a refugee )
2- beside that the law about returning the refugee to the last destination he came from is ( dublin agreement ) which is an agreement between europe countries only seychelle has nothing to do with it att all , and it was put to action to prevent such a ridicule act of sending a refugee between countries and to prevent " asylum shopping " refugee not accepting asylum in country looking for better benefits
3- still Qatar and saudia are not parts of the geneva1951 convention nor part of 1967 protocol so they have no obligation to refuge anyone but seychelle is so the responsibility of providing asylum is 100% on seychelle only and because the countries he were at are not part of the trety so still it's like he came direct from tunisia to seychelle .
4- ofcours seychelle can just do like Greece and italy did with the Syrian refuge and abanden their humanitarian obligation and just break their words and sigetures and all the credibility they have and forget about that contract they had with all the 145 countries who agreed on this agreement like kids and immature babies but this should have political consequences on one hand , and on the other hand its a HUMANITARIAN ACT what if another coup d'tet to take place in your country ??!! a bloody one or your govenment turns the guns on people like whats happening in Syria ??!!! or a tsunami or volcano ??!!! should other countries just screw you and send you back where you come from ???!!! like the argument you are making jean ??!! do you have no shame that your country have not a single humanitarian refugee .
Now is the case of the son of Bin Ali the truth is HE IS NOT A REFUGEE according to the definition of refugee in any of the treties neither political nor humanitarian , he is just a corrupt fruit of a corrupt man , someone who broke the low in his country and stole from the kids of his own people , and he will be in trial fair and by justice and no one is obligated to provide asylum for him other than who have his own reasons so seychelle shouldn't shelter him in the first place cause they actully abstracted the justice from being served for a whole year . but eventually they did it . but still all their talk about being human and supporting others is just all talk .
