THE NDEA LETTER THAT I RECEIVED. WARNING OR THREAT THE QUESTION IS WHERE DO YOU GO WHEN YOU CROSS THE NDEA? THE CEMETERY OR JAIL FOR NO REASON??



THE CASE OF RICHARD FREMINOT CIRCLED A LOT OF CURIOUS REVELATIONS AND RUMORS, FIRST WAS ON MR. CESAR AS PER FREMINOT'S DECLARATIONS SECOND AND UNCONFIRMED RUMOR IS THAT AN ALLEGATION THAT MR. FREMINOT AND ANOTHER HAD BEATEN AN NDEA'S AGENT CHILD THE ALLEGATION WENT AS FAR AS TO CLAIM IT WAS A FEMALE AND THAT IS WHY HE WAS ARRESTED.

THE PARTNER OF MR. FREMINOT CLAIMS HE WAS WORKING AND COLLECTING THE CHILDREN OF ONE MISS LUNA AT THE TIME THE SO CALLED ACCUSATION TOOK PLACE, SHE ALSO SAID THAT LUNA TESTIFIED TO THE POLICE ON MR. FREMINOT'S ALIBI YET HE WAS STILL PLACE IN CUSTODY. AS TO WHAT EVIDENCE FOLLOWED I REMAIN VAGUE AS I WAS OUT OF THE COUNTRY FOR A WHILE AND THE BLOG WAS UNDER HIGH JACK BUT I INTEND TO GET TO THE BOTTOM OF IT.

THE LETTER BELOW SENT TO ME IS WHAT I RECEIVED AFTER AIRING ONLINE FREMINOT'S VIEW AND INTERVIEW. I AM POSTING IT AS RESPONSE TO WHAT I RECEIVED RATHER THAN THE NDEA VERSION OF THINGS.


"THE QUESTION TO THIS LETTER IS WHY WAS I WRITTEN TO WHEN THE SEYLII.ORG AT EVERY CASE WHICH NDEA AGENTS INVOLVES IN AIRS NAMES OF THESE INDIVIDUAL'S AS TO SHOW CAUSE OF TRANSPARENCY AND FREE AND FAIR TRIAL? IS THERE A VERSION OF THE JUDICIARY LAW FOR THE NDEA LAW OR IS THE LAW SIMPLY A CONSTITUTIONAL VIOLATION TO OUR RIGHTS AS HUMAN BEINGS? THE YOUTUBE ALSO CONTAINS MANY PARTS OF INTERVIEWS FROM SEYCHELLES FEATURING LIAM CUNNINGHAM AND THERE AGAIN MANY AGENTS ARE AVAILED TO THE PUBLIC. SO WHERE IS THE LETTER TO YOUTUBE AS WELL? THERE ARE MORE WITHOUT A LETTER..................."

Dear Mr Issac
In regards to the recent publication and broadcasting of the alleged kidnap plot story of Miss Able, we would like to bring to your attention the legislation governing the Identity of NDEA Agents.
In the first instance the only NDEA personnel whose identity it is permitted to photograph or otherwise publish are that of the Chief Officer or the Deputy Chief Officer this is legislated under Section 15 (1) of the NDEA Act.

NDEA Act (2008) Section 15 (1)
Notwithstanding any requirement made under any Acts of any other requirement in administrative and operational procedures, including internal procedures, all reasonable care shall be taken to ensure that the identity of an NDEA agent, who is not a member of the  police or, other than the Chief Officer or the Deputy Chief Officer, shall not be revealed.

As we are sure you are well aware the publishing or revealing of the identity of NDEA Agents remains illegal and an offence punishable by a fine of up to Sr 500,000 or 5years imprisonment - or- both. This offence is covered in Section 15 (4) and I draw your special attention to Section 16 (1) (a) of the NDEA Act (2008)

NDEA Act (2008) Section 15 (4)
 Any document relating to proceedings arising out of the exercise or performance by an NDEA agent of his powers or duties shall not reveal the identity of any NDEA agent who is not a member of the police, provided that where such document is adduced in evidence, subsection (6) shall apply.




NDEA Act (2008) Section 16
16.       (1) A person who publishes or causes to be published —
 (a) the fact that an individual not being or having been a member of the police, is or was an NDEA agent; or
(b) the fact  that an individual is a member of the family of —
(i) an NDEA agent; or
(ii) a former NDEA agent; or
(c) the address of any place as being the address where any —
(i) NDEA agent;
(ii) former NDEA agent; or
(iii) member of the family of any NDEA agent, or former NDEA agent, resides,
shall be guilty of an offence.

NDEA Act (2008) Section 17
17.       (1) A person who is guilty of an offence under section 16(1) or (3), is liable on conviction, to a fine not exceeding R5,000,000, or to imprisonment for a term not exceeding 5 years, or to both.
(2) If a financial institution or other person whose trade or business is regulated by a licence or permit is convicted of an offence under this Act, the Judge may order the licence to be revoked or suspended for such period as thought proper, in addition to any other penalty or sentence that may be imposed.

In light of the above we ask that the names and identities of all NDEA agents be removed in any and all existing documentation (additionally names will be blacked out of all published or broadcasted photographed documents and photos of newspaper articles along with blacked out faces and NDEA logos on all photographs) that are already published on the internet including all websites, social media such as Facebook pages and any associated blogs that are connected to your organization.
Furthermore we would remind you that by allowing members of the public –known or anonymous – to post replies on social media pages and blogs that contravene the laws as stated above indicts the administrator/owner of such pages to be liable for prosecution.
To this end any reporting by your publication in future will not reveal the identity of any NDEA Agent other than the Chief Officer or Deputy Chief Officer in accordance with the Seychelles Laws as stated above, non-compliance will result in prosecution.
