Well the law is strange, it protects the person conducting the lewd act, not minors, or the public from viewing the stuff.

This is almost like wearing ones underwear as a hat and a hat as an underwear.

Are public porno stars like Dr. Manoo a protected class?

I would think not.

People like that need to be exposed, for whatever reason the person that loaded this stuff exposed them.

The best rule is do not film your stuff if you do not want it to be seen.

Usually people in porno know the public will see the stuff and are ok with that.

The law although under Penal Code, has no mens rea, (state of mind and intent element), so I fail to see how it can be a criminal legislation. Strange stuff at the AG office.

Computers do not commit crimes, people use computers to commit crimes, but you need to have a crime to charge a person with 20 years in jail.

Definately an item for human rights organizations to deal with and handle.

What Pp is saying is that Pornography and obscenity practice by Parti LEPEP members(define by the Butcher as Renaissance Morale)is totally legal and any one who dares criticing PP porno -politics would be sanctioned and jailed up to 20 years but if you butchered innocent Seychellois,robbed Seychellois wealth in millions,sell out their patrinomy illegally to foreigners etc... you get away from your crimes and even if in case you a minister you are promoted.

Pp and NDEA is losing the fight against drug becuase their strategy consist of chasing herb users who are not those committing crimes for i can tell PP that most herb smokers i know on Praslin are either business owners or people working hard ,though i must recognize that a handful of them are involved in herbs selling to make a living after PP bankrutpoed the country and replace Seychellois manpower by cheap foreign workers thus making Seychellois unemployed and poorer.

The drug problem the country is facing has to do with Hard Drug dealers the same the Butcher told us in 2008 that he knows them all and will deal with them.To date they still at large expending their illicit business.Moreover,repression alone as have been proven by countries with long Drug problems ,but also experience such as Mexico,USA,Colombia that repression alone do not reduce or deter Hard Drug dealers,more must accompany repression such as Legalizing Herbs which also allow a government to better control its use etc...education,prevention,family responsibility to that providing after school activities for youth such as sport activities etc..

No law can apply to past acts prior to the law being passed. This is called prohibition from Ex Post Facto legislation.

It is provided for in the constitution of Seychelles and is standard constitutional law.

Absolute defence if a charge is brought forward with a past posting.

On NDEA, I am perplexed at how they value heroin, seized in Kenya and inflated in value by them to make a case look like a big break through. The Irish are obviously trying to look good, without delivering the real results.

I notice that Today, covers every piece of rubbish the NDEA puts out there, without a question. I can only wonder why, what is the excuse this time?

Scully a sergeant in the Irish Army says that there are only 4 gangs operating drug operations in Seychelles. Fair enough, but that does not explain the 300-400 people in jail for drug related offences.Which gang did they belong to.

Finally, Scully is dishonest and scarce with critical information on his officers on NDEA, that are suspended or charged with a crime.

These people are criminals. Their names need to be made public so the public can protect themselves.

Scully obviously takes us for fools, and James Michel allows it.

We are not fools. We want the names and pictures of the officers charged.

The problem is as our own citizen can not find a dissent job on which the can live on,and as unemployment keeps sky-rocketing PP continue to import cheap labor to help accentuate the problem instead of providing Seychellois with jobs at a reasonable salary.Like,all foreign owed businesses ,foreign cheap workers help in aggravating the problem of Financial leakage which help destroy our economy and PP illiterates just do not get things right.

Sending Seychellois to thialand for whatever reason would allow them to see how bakcward we still are in regard to the lots of products our country could product from Tuna apart from Canning only.It would give them to see how retarded we are in this indsutry and how much money we lost becuase we donot produce any other products possible with Tuna than Canning which is a lost of foreign exchange for our country.

We now need a new Drug Enforcement Agency to keep an eye on NDEA.

It is hard to think that the NDEA was so heavily compromised (we suspected that after the Bel Ombre fiasco when the NDEA arrived after the drug dealers offloading their drugs had fled in speed boats), without the NDEA knowing until the drug arrests in Kenya.

Now Michel is overdoing it. He avoided Africa for years. It was pointed out to him that he was avoiding Africans while keen to fly to Arabia or Europe on the slightest pretext. So, Michel is now in Mozambique to show he has nothing against the mazembiks. Will he appoint more mazembiks as ministers ? Maybe we should not push our luck. And what about Seychelles’ problems

The Bible says that we must remove the log in our eyes before we attempt to spot the speck in the neighbour’s eyes. In many ways most of us see James Michel doing just that in relation to the discussions taking place between the two Malagasy leaders.

In the first place, here we have a president who took part in a coup d’etat to overthrow a legitimate government in an act of treason. This is exactly what Andraojoelina did to Ravalomanana.

We wonder what he might be saying to them in private? Would he be congratulating Mr. Andraojoelina for a successful coup d’etat? Would he be saying to Ravalomanana to behave like Mancham and that he could negotiate a high profile job as a roving Ambassador with all the perks? We can already see the contradictions.

But let us move a little further. James Michel is trying to help resolve the internal affairs of Madagascar and reconcile the
parties in order to move towards free and fair elections. According to him, the people of Madagascar have suffered for too long and they need a lasting solution. The words are laudable, just like any positive set of words. But how do these words match with James Michel’s own record?

How can Michel be talking about democracy and fairness in Madagascar when Seychelles itself is full of the opposite? This country is still divided along political lines because James Michel puts political consideration first. He believes he can do
whatever he wants, acting as if the country belongs to him and his party. He gives land and housing to whoever he wants, victimises his opponents and their children, his supporters get the best opportunities while his opponents have to triple their efforts in order to achieve whatever they aim for. Doesn’t that sound like what Ravalomanana is fighting against?

The electoral system in the country is going through a reform process because it is not a good one. Yet, his party is the one trying to put obstacles in the process, with the same Michel having refused so far to attend even a single meeting of the Electoral Reform Forum. How hypocritical of Mr. Michel then, wanting to get those people to sit around a table when he always refuses to sit where his opponents are gathered. What can he therefore tell those leaders that will point to the way forward? Theory only?

The Seychellois are still hurting from the many abuses of power that have taken place since the coup d’etat. All the church leaders talk about the necessity for a healing process in order for the country to receive blessings and dissipate the black cloud our country is covered under. Yet Michel believes firmly that the 5th June, the day of the coup d’etat, the day that brought political bloodshed and division, must be observed as a sacred day in our history. Again the question that we ask is what has he got to say to those leaders on a healing process to restore Malagasy unity?

Mr. Ravalomanana is being investigated by the International Court of Justice for crimes against humanity in the shooting of innocent civilians by his personal guard. If indicted, he will have to be brought to the Hague for trial. I wonder what Mr. Michel can say on the issue, given that under his regime so many innocent people have been murdered, detained without trial, sent into exile and disappeared? Can he truly talk about these issues when the log in his eyes is so huge? We must not forget that he sits comfortably next to the indicted president of Sudan, Al Bashir.

Some people will go out of their way for recognition and honour. Unfortunately by trying to place Madagascar on his plate, Michel is literally trying to chew on too much. There are so many issues to resolve in our country that we just cannot believe Mr. Michel can be sincere when trying to address the Malagasy issue. Can we please tackle our own log, Sir?

Michel can start tackling our own log by: 1. attend the reform process if it is to be a serious one;2. speak to his opponents; 3. end June 5th and June 18th as true statesman would, and hence, he will earn the respect of even his opponents.

As long as Michel fakes an opposition, fakes statesmanship, fakes the reality of Seychelles failed democracy, he will have the log stuck in his eye for everyone to see.

As long as Parti Lepep is in power, this country's institutions will be prone to corruption. We now know that this simple truth applies to the newly set up NDEA. Scully and Niall will struggle to convince this nation that the problem is limited to a few rotten apples. They will struggle to convince us that they are the right people to lead the NDEA, as this country's history is full of cases of foreigners who arrived practically penniless but went on to get rich by exploiting the corruption opportunities that Parti Lepep affords them.

It will take a lot more than what we saw this week to convince this sceptical nation that these two Irishmen are notable exceptions, as they fail to rein in the drug barons who they tell us are well known to them and presumably the Parti Lepep. Perhaps the Irishmen's work is shackled by political considerations. It is hard to believe that if these drug barons were not government supporters they would be allowed to operate with impunity. The high profile drug busts against dispensable petty dealers are just publicity stunts intended to con us into thinking the government takes the drug menace seriously when it clearly does not. When this government wants to act, getting evidence or catching the criminals red handed is the least of their worries. So we can only conclude that these known drug barons are pillars of Parti Lepep and they are protected by the state's corrupted institutions. And Scully and Niall might well be thinking that it is more than their job's worth to move against the drug barons without political support. They have been around long enough to know that this country is not Ireland. Without political support from State House, they cannot rely on the Attorney General's office, the Police, the Supreme Court and of course the disgraced Court of Appeal to lock up the evil drug barons and throw away the key.

As usual, the solution to the problems that ravage this country is staring us in the face, whether economic, politics, crime and moral decadence. We need to get rid of the Parti Lepep -- the source of all evils that plague Seychelles. Many of us have realised this. But alas far too many of our countrymen and countrywomen just do not care about the direction the country has taken under Parti Lepep.

South African prezzie Jacob Zuma is the latest to be hit hard by the Parti Lepep curse. Days after his misjudgment of involving Michel in SADC's fruitless efforts to solve Madagascar's political crisis, Zuma is under pressure at home after South African police shoot dead 34 demonstrating miners. He had to hotfoot it from SADC's meeting in Maputo to deal with the political crisis at home. Mchel's and his fellow coup plotters shot dead innocent people during the 5th June coup d'état. His police were caught trying to gas peaceful protesters on their way home. Perhaps Zuma will keep up with Seychelles politics, so that he can act with authority in regional crises. His decision to rope him Michel to lecture Malagasy leaders on good governance and constitutional changes of government was the height of hypocrisy, although ignorance was likely to be the reason. SADC has only moral pressure to apply on Madagascar. Using Michel for that was a catastrophe. Mauritius' Ramgoolam might have been a better choice as his hands are not bloodied by a bloody coup d'état.

In Maputo, Mozambique, Seychelles is being represented by James Michel, Jean Paul Adam and Claude Morel. Perhaps SADC should give Madagascar a break and put Majority Rule and Equal Opportunities in Seychelles on the agenda and discuss Michel's preference for white or light-skinned people around him while Seychelles is essentially a country of black people. It could have been worse. He could have had turncoat St Ange to tag along on the pretext that he is looking for tourists in Mozambique. He has been looking in more unlikely places. Or has he had enough of turncoats already with so many of them around him now and Pierre failing to get opposition supporters to support PDM ?

I am surprised that Ramkalawan has not seen the weakness of his stub-born perspective on life, as he approaches 60 and has not delivered what he said he would, with that approach all these years.

On that day, he took a beating on the head by some PMU marimba that weighed 380 pounds after JF grabbed his nuts in front of her. Outside, his supporters took tear gas and rubber bullets for the fiasco.

In no time, Ramkalawan, Jean Francois Ferrari, Roger Mancienne, took a settlement from SPPF for what: Scr. 180,000 each more or less.

Then the articles died out, the energy faded, and the human rights complaints were buried with the settlement money Ramkalawan took.

If fighting politics is about making money, you and Ramkalawan are better off trying to run a take away in a good location.

Soon after the dubious shameful settlement, we all recall well and good, Mr. Ramkalawan, your saviour, practically licking Michel's ears in district meetings, in St. Louis and other places. At times we could hardly tell the difference between Ramkalawan actions and Mancham's.

Later we could, Mancham would drive thru the front gates of State House with security since he was the First President, and Ramkalawan would hop in a rent a car, and drive thru the back gates of State House after 5.00, since he was the Leader of Opposition.

Soon after, what did we see, when the People of Seychelles went under IMF suffering: 1. 38% salary increase by MNA, sought by Ramkalawan, and yes, 2. 70% Pension for Life.

Today, your saviour gets Scr. 38,000.00 per month to do nothing.He got what he wanted, a pension for life, now what more does he want, to create more division in the opposition, using the likes of you, who cannot even use his name to attack someone, like a worm would, to make more money off the plight of the people of Seychelles?

The difference with Ramkalawan with Mancham is also this: Mancham took his rightful pension and left politics, Ramkalawan took his not rightful pension and stays in politics, who are you kidding?

People of Seychelles every day, are learning to recognize the smell of a stinking sell out, because they are figuring out that these sell outs, prevent change in the country and prevent SPPFPL from implementing real democracy promised 18 years ago.

Seychelles Freedom Party (SFP) has not been started in error, it is purposeful. We will not tolerate or accept opposition sell outs no matter what shape form political colour.That includes every single Independent sell out that surfaces to add more confusion to the landscape.

For us, we see no difference between SNP PDM or NDP. You have all fallen to your knees for SPPF PL funding. When you do, you cross a Rubicon of eternal failure.

Therefore, you are not a capable opponent to the SPPFPL and surely not trustworthy, because you will change your stance as the SPPFPL pay you to do so.

Sometimes it is hard to sympathise with the Brits when Latin America's two-bit honchos square up to them. Didn't Rene go to Havanna to remind us that in his student days in London he shouted "Castro Si, USA No" ? What is Alain St Ange doing talking about direct flights between UK and Seychelles with British diplomats ? Does he not know that the British Foreign Office does not have planes o carry tourists, not even the British Government ? Give me strength ! British Airways was flogged off years ago by Margaret Thatcher. Parti Lepep must sort out the tourism industry first, before commercial airlines will find it profitable to fly directly between Seychelles and European capitals. Virgin Atlantic Airways and British Airways fly between London and Mauritius because it is commercially profitable to do so, not because British diplos have ordered them to do so. The British government can't even stop wanted man Australian Julian Assange from getting on the Ecuador embassy balcony in London to stick two fingers up at Obama and Cameron, with British police within grabbing distance but helpless.

Time for Lindsay Skoll to show us that she is not just the UK diplomat to Parti Lepep. She probably does not know about Michel Tretout and she certainly does not want to be known as the British equivalent of that disgraceful French ambassador of sorts.

Which unsavoury African leader was placed on the right of James Michel that obedient Seychelles Nation felt duty-bound to remove from the photo ? Nation gives the impression that Michel was placed at the end of the table like a naughty dictator.

It can't AGAIN be Sudan's Omar Al-bashir, indicted for war crimes by the ICC. That would be geographically impossible as Sudan is in north Africa, not southern.

Could it be old comrade Robert Mugabe who longer fits in Michel's attempts to re-invent himself as a serious leader ?

Or was it SADC's failure to find a white African to sit next to Michel (and make the photo look nice for our compatriots in the less enlightened Parti Lepep bastions) that prompted Seychelles Nation to take drastic action with their pair of scissors ?

Lack of tourists is affecting all business people in the industry , as well as the country as a whole.Should St Ange have done the right thing, today our industry would have been better off as well as our economy which depend on tourism.La Porte would have not find it necessary to bigged again into our National Reserves to Keep the economy from total break dowm.
Among all those island states depending on tourism be Maldives.Mauritius,Jamaica.Dominique Repblic etc... Seychelles is the country that tourism industry is still keeping to fall apart and that becuase of fail policies taken by St Ange and PP.Mauritius did not sold out his National Airline when crisis hîtted them but took the right steps to avoid its bankrutpcy for they knew the imnportance of having a National Airline for their tourism industry.Todaauritius among other island states who also surffered the cirsis are on the raod to recovery while our country keeps falling deepr into the unknown.

Here is the AUTHORITY on this issue.

CROSS THE FLOOR in Seychelles politics is what happened when Christopher Gill told the National Assembly on 14th October 1997 that he was crossing the floor to SPPF.

Gill said he was crossing the floor.

The next day, Seychelles Nation officially announced that "GILL CROSSES THE FLOOR TO SPPF".

He asked SPPF for permission to cross the floor to them.

He took 20 minutes to explain his action. Never once did he mention that his life was in danger from his uncle, who was leader of the opposition, aided and abetted by Rene.

He said, "I declare that I want a better life for all Seychellois. And if this is what the SPPF government is realising, and if this what the SPPF party is doing, then my heart is with them. I ask them for permission to cross the floor." He added that there was a "lack of seriousness" within the Democratic Party.

The then speaker of the National Assembly, Francis McGregor said that "something exceptional had happened to one of our honourable members" and that this "had never happened before in our Assembly".

McGregor gave Gill special dispensation to make his "cross the floor speech" because the standing orders had no provision to deal with such a historic event which gave SPPF all 25 of the elected members. Nothing has really changed, then.

After this historic event, Gill never returned to the Assembly after future elections. He has been in the political wilderness ever since.
