How Can We Really Have Change In Seychelles Without Any Excuses

 Let's not use politics of Seychelles as a tool to spite hatred and violence while the same persons spreading these false gospels are profiting from the peoples vulnerability in cash and assets.

No one wants to lead Seychelles but they wish to lead its people!

The line above is clearly explained when we look at the reality of Seychelles politics. First and foremost the (same old shit) that every five years comes around knocking promising this year is our year at the pole; when the only one who really ends up doing the pole dancing for tips is the very people who thinks they are inspired to vote for change. The assembly lifetime pension defines that!

Ramkalawan and Mancham are now seeking attention through the news papers claiming that one or the other cost us Seychelles or cannot do anything for Seychelles and the seychellois people. A great lesson should be learned from that and well learned by the people of Seychelles. Temper tantrums from these guys only comes round when there is money at play and this time its the credibility of the Seychelles elections. Wavel John  Charles Ramkalawan i quote from the letter to the editor date 11th this month 2015 had this to say at the question of perks and benefits from the process, while we the people had to face "fouy dan nou touni lo airport for foreign exchange, fouy kot nou san warrant by police, viktimizasyon si ou napa en tit ouswa en top zanmi dan parti governman", just so they can ruthlessly force a fat cat salary and homes with travels from the peoples coffers.

This is only the tip of the iceberg when the same man who refuses to comment on the monetary status f himself also finds it unfair that police openly searched Navin Ramgoolams home  and exposed so many money alleged to not have been acquired from legal means. What i do not understand from Mr. Ramkalawans stand on this is short as a question. If he was president and allegations had it that in that big green Chateaux at ST - Louis there were loots and many other items alleged to had been born of illegal proceeds would he not have shown accountability to the police? Is that the quality we want from someone aspiring to become our leadership?

Well the same man and priest proposed a mere 5000 rupee pension to the people, he promised accountability for unsolved crimes from the coup in Seychelles, the selling of our patrimony and accountability to money born out of corruption if SNP comes to power!

I find it difficult to comprehend that the same man who trust's the system to bring a court case against Lepep for his beating and hospitalization, he cannot simply bring a case against these alleged corrupt individual today and "Pronto". Will he if he comes to power do like his predecessors and simply point fingers without proof only to quench the peoples thirst?

This is why Seychelles will never change with these same old shit despite it being a different day!

I would write about this but one thing Ramkalawan is right about is that Salesman Jim is no longer relevant to Seychelles politics as should he also be after so many failed attempts even violating the 3 mandate policy he boasted about that one should be aloud to serve.

The Appeal By Port authority's Lawyers, Seen As An Attempt To Discredit The Knowledge In Law Of Justice Dodin Who Was Appointed According To the Local Newspapers Then Based On His Experience, Knowledge In Law And Capability. So What Does The Appellants Lawyer Means When He states The Judge error In Law??

No Man Is An Island. If MR. N.J Desaubin Could Stand Up For His Own Right's In Seychelles And Peacefully Protest Why Do We Need These Half Baked Politicians To Take To The Streets Or Seek Our Right's For Us?

Note: The Judgement entered by justice G.Dodin in favor of the plaintiff is now being appealed on by Lawyer B. Hoareau. Furthermore the same lawyer who appealed claims from the appeal that judge Dodin erred in law making it sound as if thee same seychellois judge did not know the law and that he needs further studies for this judgement. An error in law does not necessarily means in legal terms that the judgement was wrong; rather it can also mean that the judge did not know what he was talking about and what he based his ruling on.

I for one after carefully analyzing judge Dodin's ruling i can safely see that if there are errors there; it is merely a few misspelling or typo in the verdicts documentation as shown through some, boxed in red below; besides that the law was plainly put forward. It is sometimes understandable that experience and quality of education base can vary or differ on several occasions in example:- "if i study in Mauritius for 2 years as a mechanic for Volvo then indefinitely i will not be on the same level as someone who studied in the UK or the US where the machinery is actually assembled.

"It is to be noted that since the Seychelles Broadcasting Corporation aired the Port authority's Defamatory comments on how Le Mariniere was being run while a case was still in court, and without the right of reply from MR. Desaubin. A lawsuit is going to be filed against the media and as well as against the person whom made the claims on air."

YOU EQUALLY QUOTED ON YOUR TOURISM BOARDS AND MINISTORIAL WORK TOWARDS A BETTER WAY TO ATTRACT TOURIST FOR SEYCHELLES BUT SOUNDED AS IF YOU WERE NOT TOO HAPPY OF THE NEW AIRLINES INTENT TO FAIRING IN THE BUSINESS.

QUESTION IS SIMPLE: WHY?

PRESIDENT I AGREE THAT YOU CANNOT YET COMMENT ON AN ONGOING CASE BEFORE THE COURTS AS THIS WOULD SHOW INTERFERENCE WITH THE WORK OF THE JUDICIARY, BUT I EQUALLY AGREE THAT THE AFFECTED PARTIES IN THE COURTS IS BEING SEEKING REMEDY FROM YOUR AUTHORITY UNDER YOUR GOVERNANCE! THE PARTNER OF MR. FREMINOT CLAIMS HE WAS WORKING AND COLLECTING THE CHILDREN OF ONE MISS LUNA AT THE TIME THE SO CALLED ACCUSATION TOOK PLACE, SHE ALSO SAID THAT LUNA TESTIFIED TO THE POLICE ON MR. FREMINOT'S ALIBI YET HE WAS STILL PLACE IN CUSTODY. AS TO WHAT EVIDENCE FOLLOWED I REMAIN VAGUE AS I WAS OUT OF THE COUNTRY FOR A WHILE AND THE BLOG WAS UNDER HIGH JACK BUT I INTEND TO GET TO THE BOTTOM OF IT.

Dear Mr Issac

In regards to the recent publication and broadcasting of the alleged kidnap plot story of Miss Able, we would like to bring to your attention the legislation governing the Identity of NDEA Agents.

In the first instance the only NDEA personnel whose identity it is permitted to photograph or otherwise publish are that of the Chief Officer or the Deputy Chief Officer this is legislated under Section 15 (1) of the NDEA Act.

NDEA Act (2008) Section 15 (1)

Notwithstanding any requirement made under any Acts of any other requirement in administrative and operational procedures, including internal procedures, all reasonable care shall be taken to ensure that the identity of an NDEA agent, who is not a member of the  police or, other than the Chief Officer or the Deputy Chief Officer, shall not be revealed.

As we are sure you are well aware the publishing or revealing of the identity of NDEA Agents remains illegal and an offence punishable by a fine of up to Sr 500,000 or 5years imprisonment - or- both. This offence is covered in Section 15 (4) and I draw your special attention to Section 16 (1) (a) of the NDEA Act (2008)

NDEA Act (2008) Section 15 (4)

 Any document relating to proceedings arising out of the exercise or performance by an NDEA agent of his powers or duties shall not reveal the identity of any NDEA agent who is not a member of the police, provided that where such document is adduced in evidence, subsection (6) shall apply.

NDEA Act (2008) Section 16

16.       (1) A person who publishes or causes to be published —

 (a) the fact that an individual not being or having been a member of the police, is or was an NDEA agent; or

(b) the fact  that an individual is a member of the family of —

(i) an NDEA agent; or

(ii) a former NDEA agent; or

(c) the address of any place as being the address where any —

(i) NDEA agent;

(ii) former NDEA agent; or

(iii) member of the family of any NDEA agent, or former NDEA agent, resides,

shall be guilty of an offence.

NDEA Act (2008) Section 17

17.       (1) A person who is guilty of an offence under section 16(1) or (3), is liable on conviction, to a fine not exceeding R5,000,000, or to imprisonment for a term not exceeding 5 years, or to both.

(2) If a financial institution or other person whose trade or business is regulated by a licence or permit is convicted of an offence under this Act, the Judge may order the licence to be revoked or suspended for such period as thought proper, in addition to any other penalty or sentence that may be imposed.

In light of the above we ask that the names and identities of all NDEA agents be removed in any and all existing documentation (additionally names will be blacked out of all published or broadcasted photographed documents and photos of newspaper articles along with blacked out faces and NDEA logos on all photographs) that are already published on the internet including all websites, social media such as Facebook pages and any associated blogs that are connected to your organization.

Furthermore we would remind you that by allowing members of the public –known or anonymous – to post replies on social media pages and blogs that contravene the laws as stated above indicts the administrator/owner of such pages to be liable for prosecution.

To this end any reporting by your publication in future will not reveal the identity of any NDEA Agent other than the Chief Officer or Deputy Chief Officer in accordance with the Seychelles Laws as stated above, non-compliance will result in prosecution.

I have managed to retrieve the seychelles reality blog after it had been hacked into and placed out of service.

The blog was recently over this year hacked into and placed offline after the post and interview of Richard Freminot.

Shortly the NDEA sent me a letter explaining that i will be sued if i mention ndea names rather than the ones allowed alone. Fines of up to five million or years imprisonment was expressed from the letter.

My response is as follows: "Dear sir who wrote me the letter. The names or name of NDEA agents i mention is of public knowledge and ever known from previous revelations they have made in public limelight on the sbc seychelles broadcasting corporation. It is also to be noted to your knowledge that there is a website online called seylii.org where the seychelles judiciary air's  cases and reports on cases in the essence of a free and fair justice one availed to the public. This same website whenever there is a case placed by the National drug enforcement agency publishes names and surnames of agents directly involved in the case or cases and that is somewhat liable as per your letter as well."

Whether this practice by seylii.org is to cease or the law needs to be amended remains as a constitutional matter which i will and intend to be addressing in due time. No laws should infringed a person's right only to allow a violation to go through or else we will have anarchy.

[2]               The accused denied the charges and the prosecution called Yvon Leggaie who testified that he had been an agent of the NDEA ( National Drug Enforcement Agency) for the past 5 years and  stated that on the 24^th of June 2012 he was on duty at La digue. He was working with other agents namely Moumou Bacco and Gomme and he had got information around 12.30 a.m that one Shirley Ragain had a lot of drugs with her. They had proceeded to the location around 12.45 a.m. and surrounded the house. He had instructed agents Gomme and Bacco to watch the windows and he and agent Moumou had entered through the window. They had got in and knocked on the bedroom but there was no response. Thereafter they had gone in and observed a woman sleeping on a bed and another on a mattress. He had identified himself as an NDEA agent. The two women had identified themselves, the one on the bed had said she was Jerina Marengo while the one on the floor was Shirley Ragain. He stated there were two men namely Guilaume Bochie and Etienne Kilindo in a separate bedroom.
There is also matters at hand relating to the case of Harmon Chellen's death and Bernard George frank Elizabeth's involvement in the land case which remains to be handled now that the blog is back in mode.

The real questions are: What did the autopsy report say both from seychelles and Mauritius? Is it not negligent duty when an arrested person evades the police in a police building? Should there not be an investigation in the Lady who claimed sexual abuse or harassment?

"The matter is threading on diplomatic shores and needs to be handled with the utmost diligence. whether the AG or Minister St Ange of seychelles made their statements the truth in the matter is that this issue should not be used for cheap politics and tarnish the relations between seychelles and Mauritius.

Ronny was right to seek an inquest in the matter as there are meltdowns leading to negligent duty by seychelles police in the matter. The authorities in Mauritius equally needs to be clear on the matter whether they have any reports other than what seychelles has it should be disclosed to preserve relations between both sides.

The Seychelles Police Commissioner Ernest Quatre has welcomed a judicial inquest into the death of the former Director of the Mauritius Tourism Academy, Harmon Chellen.

The inquest was announced by the archipelago’s Attorney General, Ronny Govinden yesterday.

“An inquest is a public matter, putting evidence collected and a case before the magistrate’s court is a way of showing transparency, allowing the truth to be heard and ensuring that justice prevails”, said Quatre in a statement issued by the Seychelles police this afternoon.

According to Quatre, the process, once completed, “should fully resolve any doubts which may have existed or were created in this matter.”

This relates to the alleged sexual assault against a female hotel employee with Chellen named as the suspect and the death of Chellen by drowning where his body was recovered floating in the sea.

The police statement issued this afternoon noted that the decision to formally hand over the completed police report to the Attorney General for consideration and possible inquest, was taken following a meeting between the Department of Police and Ministry of Home Affairs and Transport.

“It is to be noted and as established through our investigation that Mr. Chellen did leave the Port Glaud Police Station unnoticed and without permission, at around 12:10 hrs on the day of his death, with his body found floating in the sea near L’Illette at Port Glaud at around 14:50 hrs, that same day,” said Quatre in the statement.

The police has meanwhile reiterated calls for members of the public who may have information relating to the circumstances either in the reported sexual assault or the death of Chellen, to come forward.

I have decided to write this open letter to the newspapers because I believe that the people of Seychelles deserves to know what is going on and as to how you and your agents are looking for ways to create disorder and cause people to believe that every Seychellois whom is giving false information which you are looking for should be blacklisted by your lot.

At about three (3) weeks ago MR. Nichole Fanchette telephoned me to ask me where I am at whereby I explained to him where I was working. Shortly after; you along with MR. Fanchette came to my working place.

                               

There you asked of me if anybody had contacted me to ask me to kill or kidnap miss and central bank governor Madame Caroline Abel! I looked at you and laughed. You asked me why was I laughing and you told me that this is very serious because you wanted to know if anybody had asked me to do so. I replied to you no because that was the first time I heard this conversation coming from you! You then asked me if anyone should approach me to do so to let you know. I want to put on record that nobody has ever has ever asked me to do such a thing. Ever since (MR. Cesar) had given me some work at approximately three (3) months ago, it had become apparent that you guys had been monitoring him, surveying him for an opportunity to cause him harm. What he paid me (MR. Cesar). I managed to rent a car for me to get by with by doing runs or Pirate taxi, because I cannot find work in the country.

Ever since your visit to me, I have been stopped by the NDEA agents, searched in my car and they even went as far as crushing my 83 year old mother’s birthday cake. When I pointed this out to them, they threatened to lock me up in jail.MR. Scully has our country become a terrorist state? I did my mistake and I paid for it, are you still going to follow me around for the rest of my life? Monitor everyone that helps me to survive and create false allegation against them?

MR. Scully, I am putting you on notice that if ever something were to happen to the Lady Governor this will not have anything to do with me; because me no one has ever asked me to do such a wrongful act!

I would like to ask you why the NDEA is continuously threatening me and my life. If I am to lose my life in any weird manner I would like the people of Seychelles to know that the NDEA or those underground may be responsible, because they have placed false accusation on others. MR. Cesar also needs to watch out for his life well because those false allegations are big threats!

I thank you and would like that you also responded with an open letter for the people to know what is happen in this country.
